Supreme Court Lifts Lawyer Ahmednasir Abdullahi’s Permanent Ban

Senior Counsel Ahmednasir Abdullahi and his law firm have been granted permission to appear before the Supreme Court again after a lifetime ban was lifted.

In a decision issued on Friday, January 23, the Supreme Court revoked the prohibition, observing that the sanction had fulfilled its purpose following the lawyer’s pledges of reformed conduct and future good behavior.

Ahmednasir’s counsel recently claimed that the previous standoff with Supreme Court judges had been resolved and that he would no longer make comments that could compromise the courts’ legitimacy.

“We have determined that Senior Counsel, Mr Ahmednasir Abdullahi, an employee of his law firm, or any other person acting pursuant to his instructions, may from the date of this ruling appear and practise before the Supreme Court of Kenya,” the court ruling states.

“We are persuaded that Mr Ahmednasir Abdullahi, Senior Counsel, has had an opportunity to introspect and determine his relationship with this court going forward,” it added.

The latest ruling follows a momentous decision in January 2024, when the Supreme Court forbade the senior counsel and all lawyers linked with his legal practice from standing before it.

According to the court, he was barred due to what judges described as a long-running campaign of public insults and unethical remarks by the lawyer against the judiciary and its members.

While barring Ahmednassir, Chief Justice Martha Koome stated that his comments were largely made through social and mainstream media, in which he accused the court of corruption and incompetence.

In its letter, the Supreme Court ruled that it was unsustainable for Ahmednasir to seek justice from an institution and justices he had repeatedly disobeyed, and that he had already been warned.

The Supreme Court’s decision sparked outrage within the legal fraternity, with the Law Society of Kenya (LSK) terming the Apex court’s ruling as unconstitutional.

The law society further argued that fundamental rights, including the right for clients to be represented by a lawyer of their choice, were being undermined by the ruling.

However, Ahmednasir himself remained defiant despite the lifetime ban.

The celebrated lawyer framed the decision as a ‘badge of honour’ and threatened to file a petition challenging the decision at the East African Court of Justice.
