KDF Officer Accused Of Murder Still Free Despite Family Demands

The family of Alfie Migasha is demanding the swift arrest and punishment of a military soldier accused of fatally attacking their cousin in Nairobi’s Umoja One estate.

The request comes after an autopsy report indicated that Alfie died of a blood clot in his lung, which government pathologist Dr Johansen Oduor verified was caused by injuries experienced during the assault.

According to Dr. Oduor, the clot formed as a result of Alfie’s fractured leg sustained during the attack.

The family has described the time following Alfie’s death as one of uncertainty and anguish, begging authorities to guarantee justice is done.

“I’m appealing for justice and urging Kenyan citizens to stand with me help me at least get a vehicle to ferry his body back home,” his distressed mother stated.

CCTV footage obtained on the day of the event shows a man hitting Alfie at an entertainment venue in Umoja One on December 22, after which Alfie died from his injuries; the culprit has yet to be apprehended.

Kenya Defence Forces (KDF) members who assault or kill people can face charges under both civilian and military legal systems.

Cases are tried in civilian courts for activities committed outside of official duties, or in a court-martial for offences related to military operations or violations of discipline.

According to the Kenya Defence Forces Act and the Penal Code, murder carries a maximum sentence of life imprisonment, whereas manslaughter, if done without intent, can also result in life imprisonment.

Killing through torture or cruel treatment carries a prison term of up to 25 years or a fine of up to 10 million shillings.

Administrative actions such as dishonourable discharge, reduction in rank, or loss of benefits may also apply.

A similar case previously linked to military officers involved the October 2024 disappearance of a 20-year-old university student.

Two military personnel were detained and arraigned on murder charges, pending further legal proceedings.

In April 2024, a 30-year-old man was lured from his home by off-duty military personnel and others. Video evidence showed the victim blindfolded, beaten, and stepped on while begging for mercy.

He later died from the injuries, and the involved personnel were arrested and face murder charges.
