‘Stop Attacks On Judges’ Ruling!’ – JSC Blasts Kenyans After Protests On Bail

The Judicial Service Commission (JSC) has criticized what it views as an increasing trend of public insults and vilification against judicial professionals over bail and bond rulings.

In a statement issued Thursday, the Commission underlined its commitment to protecting judges’ and magistrates’ independence.

This comes in light of recent criticism of rulings made by the Nanyuki and Kahawa law courts.

“The Judicial Service Commission reaffirms its unwavering commitment to defending the decisional independence of all Judicial Officers and Judges,” the statement read.

The JSC voiced worry over what it described as “unwarranted personal attacks” on judicial personnel carrying out their constitutional obligations.

According to the Commission, such activities undermine the role of the judiciary and jeopardize public trust and the rule of law.

“Such conduct misrepresents the Judiciary’s constitutional role, undermines judicial independence, and corrodes public trust in the administration of justice, a cornerstone of our democratic society,” the Commission stated.

While the JSC acknowledged the public’s interest in court decisions, it emphasized that bail and bond determinations are not decided randomly.

The Commission stated that judicial officers make such decisions based on the Constitution, the Criminal Procedure Code, and the Judiciary’s Bail and Bond Policy Guidelines.

It warned that such personal assaults not only weaken due process, but also jeopardizes the safety of judicial workers and the integrity of court findings.

“Resorting to personal attacks against Judicial Officers subverts due process and imperils the sanctity and independence of the Judiciary,” it added.

To ensure the continuous security of judges and court staff, the JSC told the public that the Office of the Chief Registrar, in collaboration with the Judiciary Police Unit, is prepared to offer the necessary protection and support.

“The Judiciary leadership is fully committed to supporting judicial officers and court personnel, especially during this period of heightened concern.”

The Commission congratulated judges and magistrates around the country for their dedication, asking them to carry out their constitutional responsibilities without fear or favour.

“We encourage all judicial officers to continue discharging their mandate with integrity, courage, and fidelity to the law, free from bias or undue influence.”

The JSC invited leaders, stakeholders, and the general public to engage in respectful dialogue with the judiciary.

The JSC was established under Article 171 of the Constitution and is obliged by Article 172 to promote and defend the Judiciary’s independence and accountability.

The Commission is critical in ensuring that judicial personnel remain free of extraneous pressure and intervention.

The statement comes as political and public criticism of court rulings has intensified, creating new concerns about the threat to judicial independence in Kenya’s expanding democratic arena.
