Babu Owino Appeals Bail For The Mawego Eight After Ksh50k Ruling

Embakasi East Member of Parliament Babu Owino has stated that the eight suspects arrested on suspicion of torching the Mawego Police Station earlier this month have been released on bail.

Following their appearance at the Kahawa Law Courts on Thursday, July 31, the politician and attorney claimed that the eight were granted Ksh50,000 cash bail apiece.

However, he indicated that, as the defendants’ lawyer, he would challenge the court’s judgment on the grounds that the suspects could not afford bond.

“Today at Kahawa Law Courts, representing the Mawego 8 who have been released on cash bail of Ksh50,000 each,” the MP stated.

“We will appeal this decision by the court because my clients can’t afford the cash bail, and it amounts to pretrial detention for the fishermen and Bodaboda riders from Homabay County.”

He added: “Nevertheless, this is yet another win for us after securing their release on bail and/or bond.”

The eight are among many charged with terrorism in the aftermath of the June 25 and July 7 protests, in which at least 60 people died.

However, this particular group was detained for reportedly burning down the Mawego Police Station on July 3.

It was the day Albert Ojwang’s body arrived in Homabay following his suspected murder at Nairobi’s Central Police Station.

A massive mob marched to the police station where Ojwang was initially lodged following his detention weeks earlier.

However, the situation worsened when many structures at the station were set on fire.

On Tuesday, July 15, the eight were arraigned and charged with terrorism-related offenses in Kahawa Law Court.

They were charged under the Prevention of Terrorism Act No. 30 of 2012 and the Penal Code with committing a terrorist act, arson, and malicious property damage.

They had already been imprisoned by custodial orders granted by the Oyugis Law Court before being re-arrested on July 14, 2025, following the resolution of a miscellaneous application.

They, like Ojwang, were brought to Nairobi’s Anti-Terrorism Police Unit (ATPU) headquarters for further processing before being arraigned.
