
Former DP Gachagua Drops Reinstatement Bid, Seeks Full Impeachment Compensation
Rigathi Gachagua has dropped a prayer seeking his reinstatement as Deputy President in a new twist.
The new development was confirmed by Gachagua’s legal team on Monday, April 27, who announced that instead, the former DP would seek compensation over his impeachment.
Speaking during the impeachment hearing at the Milimani law Courts, lawyer Paul Muite told the court that the former Deputy President is seeking compensation for remuneration, damages, and loss arising from what he terms as an unlawful and procedurally flawed removal from office.
“The petitioner has abandoned the prayer for reinstatement as Deputy President,” Muite told a three-judge bench comprising Justices Eric Ogolla, Anthony Mrima, and Freda Mugambi.

He went on, “The core of those prayers can be summarised as the quashing of the impeachment and payment of the remuneration and benefits he would have otherwise earned as provided by law.”
Muite further told the court that for the 2.5 years Gachagua served as the second Deputy President, Article 151 of the Constitution fully applied, and therefore any attempt to remove him outside those constitutional protections was unlawful.
“For the 2.5 years that Gachagua served as the second Deputy President, it is our submission that Article 151 of the Constitution fully applies. Impeachment cannot and should not be applied retrospectively; that is our submission,” he went on.
The petition presented by Gachagua’s legal team further argued that the entire impeachment process was designed to justify a predetermined outcome with minimal public opinion.
Further, the court also heard that Gachagua had 18 arguments which he wished to be heard by the three-judge bench to decide his case.
Following the hearing, a second hearing on the matter has been slated for May 7, while a third one set for May 8.
The former DP’s team had initially slated successive days for the hearing of the petition, but the court turned down the request.

The court insisted that it would be impractical to sit on Tuesday, April 28, because of the Supreme Court judges’ interviews.
Perks Gachagua is Seeking
A Kenyan Deputy President is entitled to a gross monthly salary of Ksh1.2 million, which is complemented by an array of benefits.
Which includes house allowances, entertainment stipends and a lifetime pension which is equivalent to 80 per cent of their final salary.
As per Gachagua’s team, the total value of the ‘lost’ earnings from the former DP’s impeachment and future benefits exceed Ksh450 million.
