EACC Vows To Go After Ksh1.5 Billion Ruaraka Land Case Officials

The Ethics and Anti-Corruption Commission (EACC) has announced efforts to reclaim Ksh1.5 billion and resume criminal proceedings in the dispute over land occupied by Ruaraka High School and Drive Inn Primary School.

The development comes after a Court of Appeal decision affirming the Environment and Land Court’s ruling that the compensation granted to two corporations was illegal since the disputed area was public land.

In a statement issued on Monday, July 6, the Commission stated that the verdict corroborated its investigations, which revealed that the area had already been transferred to the government via an approved subdivision scheme and thus constituted public land.

โ€œThe judgment affirms the findings of investigations conducted by the Commission into allegations of irregular compensation relating to the portion of the land measuring 13.5 acres on which the two public schools stand,โ€ the statement read.

The companies had filed an appeal seeking to overturn the earlier ruling, declare the disputed land private property, and compel the National Land Commission (NLC) to pay an additional Ksh1.769 billion in compensation.

They had already received Ksh1.5 billion in compensation, which the judges ruled was unlawful because the government cannot compulsorily acquire land it already owns, prompting the EACC to begin recovering the funds.

In addition, with the appeal now concluded, EACC said it will resubmit the file to facilitate criminal prosecution of those found culpable.

The commission confirmed that investigations into the role of public officials and other individuals involved in processing the payment were completed.

It disclosed that the inquiry file had been submitted to the Director of Public Prosecutions (DPP) in February 2025, but prosecution was deferred pending the outcome of the appeal.

โ€œFollowing the determination of the appeal, the Commission has resumed action on the matter and will resubmit the inquiry file to the DPP,โ€ the statement read.

“Those found culpable will be prosecuted in accordance with the law.”

Further, the commission called on the Ministry of Education and the NLC to process title documents for the land occupied by the two schools to secure it as public property.

The EACC said it had secured the original title deed and placed a caveat over the parcel of land to safeguard public interest after the compensation was paid.
