DCI Has Arrested Former MP Over Land Fraud
Silas Mwaita, a former Baringo Central Member of Parliament, was detained on Sunday, August 3, on suspicion of multiple illegalities, including land fraud.
The Directorate of Criminal Investigations (DCI) verified Mwaita’s detention, saying he was seized by detectives in Kilimani.
According to the DCI, Mwaita and his accomplice have been under investigation for a felony conspiracy.
Mwaita is suspected to have been implicated in a land fraud case involving two prime properties on Mai Mahiu Road in Nairobi West. The DCI estimates that both plots are worth millions of shillings each.
“Detectives have today arrested Hon. Sammy Silas Komen Mwaita at Kilimani for the offences of Conspiracy to commit a felony, Making a document without authority, Abuse of office and giving false information to a person employed in the public service,” a statement from the DCI read.

Aside from conspiracy to commit a crime, Mwaita is accused of creating a document without permission, misuse of office, and providing false information to a public servant.
The former MP’s arrest was suggested by the Director of Public Prosecutions, who gathered enough information to justify his detention before contacting the DCI.
Mwaita, who was originally elected as Baringo Central MP in 2007, has been a source of contention in recent years, with the Ethics and Anti-Corruption Commission battling the lawmaker since 2009.

Before becoming an MP, Mwaita was a long-serving public servant who temporarily served as Commissioner of Lands during the Moi administration from 2000 to 2003.
In 2022, Mwaita, who had been Baringo Central MP for two months, was called by the EACC on charges of abuse of office, conflict of interest, and fraudulent acquisition of public property.
Two years later, the former MP’s name was once again involved in a contentious land dispute being investigated by the EACC.
At the time, the EACC announced the recovery of a prime tract of property in Kakamega that was allegedly improperly given to a defendant while Mwaita was the lands commissioner.
