Dutch National Who Assaulted Police In Diani Freed For Being Bipolar
Elwin Ter Horst, a Dutch national who was detained two weeks ago for attacking a police officer in Diani, Kwale County, has been freed unconditionally after the Kwale Law Court found that he is unable to stand trial owing to health issues.
Senior Resident Magistrate Joy Mutimba issued the verdict on Friday after obtaining a medical report from Port Reitz Hospital, which revealed that the accused had bipolar disorder and another health condition that prevents him from entering a plea.
Ter Horst was facing four accusations, according to court documents: drug trafficking, assault inflicting bodily harm, malicious property damage, and producing a disturbance.
Last month, the Dutchman was arrested for 14 days after being caught on tape verbally abusing, demeaning, and spitting at a police officer at Diani Police Station.

This came after Rosemary Nandi, Senior Assistant Director of Public Prosecutions (SADPP), requested extra time from the court to conduct the inquiry.
He was also charged with beating his Kenyan girlfriend, Angela Atieno, in a separate incident.

The National Police Service (NPS) later criticized the harassment of police officers after a viral video showing the foreigner shouting at cops, hurling slurs, and spitting on a male officer at the station surfaced online.
In a strongly worded statement, NPS Spokesperson Muchiri Nyaga described the conduct as “crass, despicable, and utterly unacceptable behaviour,” adding that such behaviour undermines the integrity and dignity of law enforcement service.
He further commended the officers involved for their “restraint and professionalism” despite the provocation, noting that their conduct reflects the “high level of discipline and maturity” expected of officers.
