Court Rules On Evicting Nairobi Matatus Operations
The High Court has granted a temporary respite to 13 matatu SACCOs operating in Nairobi petrol stations following a verdict ordering the Energy and Petroleum Regulatory Authority (EPRA) not to evict them.
As a result, the SACCOs will continue to operate at various petrol stations throughout Nairobi until the petition to stop the EPRA eviction notice is considered and decided in court.
The SACCO’s counsel, Danstan Omari, has stated that evicting the stations will cause uncertainty in the industry, disrupt business, and jeopardize the livelihoods of people who rely on the stations as important pick-up and drop-off locations.
EPRA and the Nairobi County administration issued eviction notices to the matatus, prompting them to file a court petition.
Speaking after the verdict by High Court Justice Chacha Mwita, the matatus’ lawyer stated that they sought temporary relief after obtaining credible information that the county intended to evict them today, November 19.
“My clients who are members of the matatu industry, both employees and matatu owners, got summons for eviction from where they are operating in petrol stations,” he said.
“Those summons came from EPRA and told them to vacate with immediate effect.”

Adding, “Aggrieved with that, we filed a petition, suing specifically EPRA and the Nairobi County Government and the Attorney General. Directives were issued, and we appeared before Justice Chacha Mwita today.”
Furthermore, the court ordered the legal teams representing EPRA, the county administration, the petrol stations, and the SACCOs to convene and confer within seven days to negotiate a resolution to avert an oncoming crisis if the evictions are carried out.

As a result, the lawyer indicated that they will be writing to the other teams to schedule the meeting as early as tomorrow, Thursday, November 20.
The resolutions will be presented before the High Court when the case goes before the court on December 1.
On Monday, November 17, the matatu companies threatened to down their tools over alleged intimidation by the Nairobi County government and the EPRA.
They had approached the High Court seeking urgent orders to stop EPRA from enforcing a ban on picking up and dropping off passengers at petrol stations within the Nairobi CBD.
