Rogue Teacher Who Caned Student 107 Times Fined Ksh300K
A teacher who was found guilty of abusing a student by canning him 107 times was fined Ksh300,000 or imprisoned for three years by a Nyamira court.
This comes after the Office of the Director of Public Prosecutions (ODPP) accused him of murder, but the Court cleared him of the allegations.
Due to the prosecution’s lack of sufficient evidence, Keroka High Court Magistrate Eunice Nyuthu cleared the 29-year-old of the murder allegations.
“I am satisfied that even though the evidence tendered in court cannot sustain the charge of attempted murder, it nevertheless supports the offenses of unlawful winding under the penal cord and cruelty to a child under the Children Act,” Magistrate Nyuthu stated.

However, the teacher did not escape punishment as the court sentenced him to three years in prison for child abuse.
“I find that the charge of cruelty to a child is more appropriate. The accused person breached this duty by assaulting the complainant and causing him bodily harm. This amounts to a criminal offense for which I find him guilty,” the Magistrate ruled.
The accused had violated the Constitution’s ban on corporal punishment, the magistrate observed.
“The accused is hereby sentenced to a fine of Ksh300,000, in default, three years imprisonment; the right of appeal is 14 days,” the Magistrate further asserted.
In response to the sentencing, the family of the assaulted student said they were unhappy with the ruling and planned to file an appeal.

The student was disciplined by the accused on March 26, 2023, for allegedly losing his school outfit.
The harsh punishment was allegedly given by the teacher using a plastic pipe. The ODPP wanted to charge him with murder, but officers had suggested that he be charged with assault.
According to the prosecutors, the abuse might have had lethal results.
According to a medical study, the student had a hematoma, which is a potentially fatal buildup of clots of blood in his tissues that may have been prevented with timely medical care.
