3 Demands LSK Has Issued DPP, DCI After Wajir MCA’s Mysterious Death

The Office of the Director of Public Prosecution (ODPP) and the Inspector General of Police were challenged on Wednesday to expedite investigations into the murder of Yussuf Hussein Ahmed, a member of the Wajir County Assembly for Della Anole Ward.

In a statement issued on Wednesday, October 23, the Law Society of Kenya (LSK) made three demands to the ODPP, led by Renson Ingonga, and the Office of the Inspector General of Police, led by Douglas Kanja.

First, the society demanded an immediate investigation into the MCA’s alleged kidnapping and murder after the family confirmed his body had been discovered in Lake Yahud.

“We demand an immediate, thorough, and independent investigation into the abduction and murder of Hon. Yussuf Hussein Ahmed,” LSK President Faith Odhiambo stated in the statement.

“We urge the Director of Public Prosecutions to exercise his powers under Article 157(4) of the Constitution and direct the Inspector General of Police to urgently conduct investigations to apprehend and prosecute all those involved in this heinous crime.”

LSK also demanded that all law enforcement agencies strictly follow the rule of law in the performance of their duties.

“Extrajudicial killings and enforced disappearances must not be tolerated in a country that upholds constitutionalism and human rights,” read the statement.

The body also demanded that all of the perpetrators of the crime be brought to justice, in an effort to quickly restore trust in the country’s judicial system.

LSK condemned the heinous events that led to the MCA’s death and pledged to closely monitor the case to ensure that the family receives the justice they deserve.

“LSK will continue to monitor this case closely to ensure that justice is not only pursued but also served,” the LSK chair continued.

In a statement dated September 27, LSK filed a petition following the abduction of the MCA after receiving a report from his family that he was abducted by unknown assailants on Friday, September 13th.

The family later confirmed that his severely mutilated body was discovered at Lake Yahud three weeks after his disappearance.

Prior to the discovery of his body, the court issued orders on September 26 directing the Director of Public Prosecutions and the Director of Criminal Investigations to either produce the MCA in court or explain why he could not be produced.

While both the DPP and the DCI appeared in court, they failed to follow the court’s orders.

Following the tragic death of the MCA, family members and relevant stakeholders are demanding justice. His burial has been postponed to allow a postmortem to determine the cause of death.
