ADANI DEAL: ‘There’s No Evidence!’ – Lawyers Express Concern About Ruto’s Cancellation Claims

Two months after President William Ruto stated that Kenya had canceled its partnerships with the notorious Indian company Adani, questions have been raised that there is no evidence that the accords were actually canceled.

President Ruto revealed during his State of the Nation address in Parliament on November 21, 2024, that after careful thought and listening to Kenyans, he had chosen to cancel both the KETRACO and JKIA accords due to the US’s corruption allegations against Adani.

“I have stated in the past, and I reiterate today, that in the face of undisputed evidence or credible information on corruption, I will not hesitate to take decisive action,” Ruto stated at the time.

Lawyer Ndegwa Njiru has expressed concern that there has been no further evidence that the deals were terminated since Ruto’s statements.

They were making their statements on the Kenya Electricity Transmission Company Limited (KETRACO)-Adani case, which Kalonzo Musyoka and other politicians had brought to challenge the contract.

“As we stand before your lordship, there is no evidence other than mere presidential pronouncements made in Parliament that the deal was canceled,” Lawyer Ndegwa Njiru pointed out.

“There is no affidavit before your lordship indicating to that effect abreasting the court on the status of that contract.”

Ndegwa indicated that his team does not believe in the transaction because it was done in secret from the start, and they saw malice even in the supposed withdrawal.

“We take judicial notice that this is a matter that was done in pure concealment and we do not read any good faith on the part of the respondents,” the lawyer continued.

Lawyers Kalonzo Musyoka and Eugene Wamalwa were also present at the hearing, having filed a petition with the High Court to contest the deal.

Despite the fact that the deal was cancelled, the lawyers pleaded that the petition not be lost and wasted.

Advocate Ezra Makori, representing Adani Group, requested an exemption from the case in November 2024 because the projects had been terminated.

High Court Justice Bahati Mwamuye ordered the respondent in November to show evidence that the deals were really cancelled; however, Njiru claims that the evidence was not supplied.

The Milimani Court allowed the respondents 30 days to answer before the case was heard again.

The Adani JKIA and KETRACO transactions sparked outrage in Kenya, with Kenyans passionately protesting the company’s involvement, which was to take over the airport and electricity transmission for 30 years.
