IG Kanja Finally Appears Before Court, Speaks On The Missing Mlolongo Three

Douglas Kanja, the Inspector General of Police, appeared in Court on Thursday after ignoring summonses.

The IG informed the Judge that the three brothers who went missing in December are not in police custody, which is a disturbing development.

Kanja, who appeared before Justice Chacha Mwita on Thursday at the Milimani Law Courts in Nairobi in response to pleas to bring the three in court, stated that the three missing persons were not in any of the police stations.

“Your honour, we have none of the subjects. I want to confirm before this court that we have none of them,” Kanja stated. 

The police chief, however, informed the court that the National Police Service (NPS) has been aggressively investigating the three’s whereabouts.

He further stated that upon receiving information on the missing three, he asked the Directorate of Criminal Investigations (DCI) to promptly commence investigations into their whereabouts.

DCI chief Amin, for his part, stated that they were actively probing the disappearance of the three.

He stated that once completed, the file would be handed to the Office of the Director of Public Prosecutions (ODPP).

“I wish to confirm that the investigations are still on course and at an appropriate time, the files will be forwarded to the ODPP,” Amin stated.

“Finally, I wish to state that the missing persons are not under the custody of the national police service. We have not been arrested and they are not under our custody,” he added.

However, the DCI leader argued that they were not in a position to comply with court orders instructing them to produce the three in court as their whereabouts remained unknown.

“We can neither present the bodies nor can we formally prefer any charges against them because they are not under our custody,” he added.

Kanja and Amin had ignored multiple court summons that compelled them to appear before the court over the abductions of the three men in Mlolongo on different dates in December.

Kanja’s decision came after he stated that he would appear in court to answer the summons, claiming that he was a law-abiding citizen.

“When the time comes for me to appear in court I will appear. When I am ready I will appear before the courts,” Kanja told reporters who pinned him down during a press conference in Kwale County on January 23.

This came after their previous attempt to avoid the summons failed when Justice Mwita decided that the two police chiefs had been correctly served.

The orders were compelling them to appear in court concerning the disappearance of three individuals reportedly abducted in Mlolongo.

At the time of publication, the court allowed Kanja and Amin to leave the chambers after executing the summons.

However, the court was still in session regarding the subject.
