Gloria Orwoba Ordered To Pay Senate Clerk Ksh10 Million for Defamation

Gloria Orwoba, an ex-nominated senator, has been sentenced to pay Senate Clerk Jeremiah Nyegenye Ksh10.5 million in damages after being found guilty of defamation.

Magistrate Ruguru Ngotho issued the decision on Monday.

The Milimani Commercial Court convicted Orwoba of spreading malicious posts on her WhatsApp stories, Facebook page, and X, claiming the Senate Clerk of sexual harassment.

The court also ruled that Orwoba’s posts were not protected by parliamentary privilege and were posted with the malicious purpose to harm Nyegenye’s reputation.

As a result, Nyegenye was granted Ksh8 million in ordinary damages and Ksh2.5 million in exemplary and aggravated damages.

Furthermore, Orwoba must give a public apology within 30 days or face further default damages of Ksh1 million.

An injunction was also imposed on Monday, prohibiting Orwoba or any of her accomplices from making any additional defamatory remarks about the clerk.

The former nominated Senator’s problems began in 2023, when she made derogatory comments against the Senate Clerk on her Facebook page, claiming him of retaliation after she denied his sexual advances.

“Clerk of the Senate Jeremiah Nyegenye solicited for sexual favours from me… and once I refused… the retaliation began,” Orwoba said in the explosive comments.

What followed was a legal battle in which Nyegenye, through his legal team, requested that Orwoba recant her claims.

Orwoba was therefore barred from making any additional defamatory statements about the Clerk of the Senate.

The court ruled on Monday that Orwoba failed to support the charges, resulting in a libel action.

“It was incumbent upon her to go the extra mile to justify her statements. She did not,” the magistrate observed.

Nyengene’s counsel also testified, alleging that the claims had caused tremendous mental agony for the Senate clerk and his family over the years.
