Ferdinand Waititu Faces More Charges While Already In Jail
Former Kiambu Governor Ferdinand Waititu’s legal difficulties look to be far from over, as he was charged with new crimes while in prison on Tuesday, November 11.
In addition to the graft case in which he was found guilty, Waititu was accused again on September 29, 2024, for remarks allegedly made at Ruiru Stadium in Kiambu County.
According to prosecutors, the former county boss’s words at a public gathering were intentionally inflammatory and had the potential to disrupt the country’s peace.
In his claimed address, Waititu appeared to oppose impeachment proceedings against former Deputy President Rigathi Gachagua, claiming that ‘if Gachagua goes home, President Ruto must also go’.

The prosecution further informed the court that the remarks were directed at specific groups such as hustlers, market vendors, boda-boda operators, and clergy, with the intent of inciting unrest.
Waititu’s actions are believed to have violated Section 94.1 of the Penal Code, which especially deals with comments that could incite public commotion.
The Office of the Director of Public Prosecutions has chosen to vigorously pursue the case in light of the charges, and a court hearing is scheduled for next week.
Waititu is currently being incarcerated at Kamiti Maximum Prison, where he is serving a 12-year sentence for conflict of interest and dealing with questionable property.

His lawyers launched another bid to secure his freedom in September 2025, but the application was denied after he failed to raise the required bank guarantee to secure his release.
His legal team had made similar appeals three times before, but High Court Justice Lucy Njuguna decided that such applications would just delay the judicial process.
Following his first February conviction, Waititu was granted a temporary reprieve by being released on a Ksh53 million bond until the hearing and outcome of his appeal, which sought to have his imprisonment dismissed.
In addition to his 12-year prison sentence, the former Governor was forbidden from holding public office for ten years.
