Frustrated Judge Sternly Warns IG Kanja, DCI Amin Over Missing KDF Soldier
A High Court judge has delivered a severe rebuke to Kenya’s top security officers for failing to appear in court to explain the whereabouts of missing former KDF soldier and security analyst Mwenda Mbijiwe.
Speaking in court on Tuesday, December 16, Justice Martin Muya expressed his unhappiness with Inspector General of Police Douglas Kanja and Director of Criminal Investigations Mohamed Amin’s antics.
This comes after the duo sent representatives rather than attending in person to clarify what is known about security analyst Mwenda Mbijiwe.
Mbijiwe has been missing for over four years since his alleged kidnapping.
Advocate Paul Nyamodi and an investigative officer represented the two senior cops, which upset Mbijiwe’s bereaved family.
This is the story of Mwenda Mbijiwe,a former Kenya Air force Officer who was abducted in 2021 and has never been seen close to five years now.

Mbijiwe’s mother, through her legal team, advocated for the issuance of arrest warrants against Kanja and Amin for failing to appear in court.
Nyamodi defended his absence, arguing that his clients had not been properly served with the summons.
“I took time at the beginning to explain that the investigating officer is present and that the court made directions for the two senior officers without having had an opportunity to hear the status of the investigations,” Nyamodi submitted.
He contended that the investigating officer was in a better position to keep the court informed of the case’s development.
The lawyer also claimed that Mbijiwe’s mother did not officially report her son missing to the police.

Under cross-examination by Justice Muya, the investigating officer stated that a missing persons report had been filed by Mbijiwe’s wife at Lang’ata Police Station.
Meanwhile, a separate report was later lodged by his stepmother in 2021.

Family lawyers dismissed the debate over who filed the report, insisting the key issue was that the disappearance had been reported and remained unresolved.
Appearing visibly frustrated by the exchanges, Justice Muya issued a firm caution, urging parties to stop evasion.
He stressed the seriousness of the matter and called for full openness and cooperation from everyone involved.
