Ruto Nominates Supreme Court Judge For Influential ICC Position

President William Ruto has appointed Supreme Court Judge Njoki Ndung’u as Kenya’s candidate for the upcoming election of International Criminal Court (ICC) judges in December.

Ndung’u, who has served as a Supreme Court Judge since 2011, is set to go head-on with other candidates from across the world, who are also set to contest for the seat at the ICC, The Hague, Netherlands.

Other candidates that have been nominated for the elections across the globe include Deo John Nangela from Tanzania, Rosette Muzigo from Uganda, Everlyn Ankumah from Ghana, Guénaël Mettraux from Switzerland, Yoshimitsu Yamauchi, and Diana Carolina Olarte from Colombia.

Ndung’u served as a Member of Parliament in the National Assembly for the 9th Parliament, representing the National Alliance Rainbow Coalition (NARC) from 2003 to 2007.

Ndung’u was appointed as a Judge of the Supreme Court on June 16, 2011, and was part of the inaugural bench of the Supreme Court, having been nominated by the Judicial Service Commission (JSC) and subsequently assuming office on August 26, 2011.

Over the past 14 years, Ndung’u has been part of a seven-judge bench that has handled some of the country’s complex cases, especially presidential disputes.

Notably, she sat on the panel that ruled on the 2017 presidential election petition, which resulted in the annulment of the initial election and the ordering of a repeat vote.

If she clinches the position, Ndung’u will be responsible for presiding over cases involving the most serious international crimes, including genocide, war crimes, and crimes against humanity.

The moves come at a critical time, with Kenya less than two years away from the highly anticipated 2027 General Elections.

Her exit would leave the apex court with one fewer judge.

The announcement comes at a time when the Judiciary Service Commission is in the process of appointing another Supreme Court judge.

This follows the death of Justice Mohamed Ibrahim, who passed away on December 17 last year after a long battle with illness.

In a statement on  Wednesday, February 25, JSC said that it had received six applications for the position of a Supreme Court judge following the lapse of the application deadline on February 17, 2026.

Among those who applied for the position are Justice Katwa Kigen, Justice Joseph Kiplagat Sergon, Justice Warsame Mohammed, Justice Francis Kipruto Tuiyot, Anne Waceke Kiratu Makori, and  Lilian Wanjiku Wachira.
