High Court Orders DCI, Police To Produce Missing Nairobi Businessman

High Court Judge Alexander Muteti has ordered the DCI and the Independent Policing Oversight Authority (IPOA) to continue their independent investigations into the alleged arrest and disappearance of Kiamaiko businessman Abdulaziz Duba Molo, popularly known as Zizou, and three other men.

Justice Muteti said the investigations by the two agencies should continue alongside those being conducted by the police, noting that each institution had a complementary role in establishing the whereabouts of the missing men.

“The fact that the police are investigating the matter should not prevent other investigative agencies from continuing their investigations since each agency will be playing a complementary role in trying to locate the suspect and informing the court on the whereabouts of the subject,” the judge ruled on Friday.

The judge further directed the DCI and IPOA to continue with their investigations in the spirit of transparency and accountability and keep the court informed on their progress.

“The two agencies, in the spirit of transparency and accountability be and are hereby ordered to continue their independent investigations into the arrest and disappearance of the subject,” Justice Muteti said.

The orders were issued during proceedings in a habeas corpus application seeking to compel Inspector General of Police Douglas Kanja to produce Zizou, Macmillan Kiarie Mugo, Michael Oloo and Evans Otieno, who are alleged to have been abducted by police officers.

Zizou was allegedly abducted by masked men travelling in a Toyota Fielder on June 23, 2026, with his disappearance triggering protests along Outer Ring Road as residents demanded answers over his whereabouts.

The High Court also directed that the case be heard in camera, meaning proceedings will be conducted privately and members of the public will be excluded from the courtroom.
