Dreaded Uhuru-Era’s 15 SSU Officers Charged Over 2022 Indian Nationals Kidnapping
The Office of the Directorate of Public Prosecutions (ODPP) has filed 17 fresh charges against 15 officers of the disbanded Special Service Unit.
The officers were drawn from the Directorate of Criminal Investigations (DCI) and the National Intelligence Service (NIS) over the 2022 kidnapping of two Indian nationals and their Kenyan driver.
Through a charge sheet, among the charges is kidnapping with intent to murder, an offence provided for under Section 258 of the Penal Code.
Additionally, the officers also face a charge of conspiracy to commit a felony, contrary to Section 393 of the Penal Code, which defines and penalizes the offense of conspiracy to commit a felony.
Another charge accuses them of subjecting a person to cruel, inhuman, or degrading treatment, contrary to Section 51(3) of the National Intelligence Service Act.
The Act states that any member of the service who subjects a person to cruel, inhuman, or degrading treatment commits an offense.
The charge sheet further includes counts of forgery, arising from documents linked to the alleged operation.
Some of the officers are separately accused of committing cruel, inhumane, and degrading treatment against the victims.
Others face a charge of cooperating in the execution of cruel, inhuman, and degrading treatment during the same incident.
According to the prosecution, the officers travelled in four motor vehicles on July 22, 2022, and intercepted a car in Nairobi carrying the two Indian nationals and their Kenyan driver.

The fresh charges come after the High Court of Kenya terminated murder proceedings against 15 security officers accused of the July 2022 abduction and killing of two Indian nationals and their Kenyan driver.
The victims, Zulfiqar Ahmed Khan and Mohammed Zaid Sami Kidwai, had worked on the digital campaign team for William Ruto during the 2022 general election, alongside their Kenyan taxi driver.
The three men disappeared on the night of July 22 into July 23, 2022, after being intercepted near Ole Sereni Hotel along Mombasa Road.
This led to the arrest of 15 security personnel, comprising 13 disbanded DCI Special Service Unit officers, one NIS officer, and one KWS warden.
The 15 officers are expected to appear before the Kahawa Law Courts on September 7, for plea-taking in front of Senior Principal Magistrate Njeri Thuku.
