KFS Responds To Alleged Muthaiga Golf Partial Annexation In A 21.8ha Karura Forest Land Dispute
The Kenya Forest Service (KFS) has responded to a dispute over land claimed by Muthaiga Golf Club in the Karura Forest area.
KFS said approximately 21.8 hectares of the property claimed by the golf club fall within the legally gazetted Karura Forest.
The disputed parcel is identified as Land Reference (LR) No. 13134/3, which Muthaiga Golf Club claims to own.
The competing claims have sparked a disagreement over the legally recognised boundary between the golf club and Karura Forest.
“Karura Forest was surveyed in the early 1920s, with the survey being registered in 1923,” KFS said in a statement.
The forest agency added that Muthaiga Golf Club’s parcel “encroaches onto the gazetted Karura Forest by approximately 21.8 hectares.”
According to KFS, the area was later declared a Forest Reserve through Proclamation No. 44 of 1932 before being gazetted as a Central Forest under Legal Notice No. 174 of 20 May 1964.
The dispute has affected access to part of the golf course, with the Front Nine, comprising holes two to nine, subject to restrictions as KFS maintains that the section falls within the gazetted forest.
The agency said the competing ownership positions would be discussed during a meeting with Muthaiga Golf Club at its headquarters, with both sides expected to seek an amicable resolution.

The KFS position comes amid claims that the forest agency unlawfully took over private property.
However, the agency maintains that the disputed section forms part of land legally reserved as Karura Forest.
Historical records on Karura Forest have documented disputes over sections of the forest boundary, including the area bordering Muthaiga and the position of the Getathuru River.
The two form a part of the boundary thathas previously been identified as an issue requiring further verification through a re-survey.
The dispute could therefore require the parties to examine historical survey plans, boundary records and land ownership documents to establish the precise position of the disputed parcel and determine how the 21.8-hectare overlap arose.
Further, the outcome of the planned meeting could determine whether the parties reach an agreement on the boundary or pursue further action through the relevant land and government authorities to settle the competing claims.
