‘Avail Yourselves!’ – Judge Orders IG Kanja, DCI Amin’s Presence In Court

The High Court has refused to overturn orders mandating the personal attendance of IG Douglas Kanja and DCI boss Mohamed Amin in court over the alleged abduction and disappearance of three individuals in Mlolongo last year.

Justice Chacha Mwita stated that the order he made in January this year was designed to respect the Constitution and execute the Bill of Rights.

“Securing the lives of the three missing men remains a priority for this court. It will not be in the public interest to allow the application by the IG and DCI,” said Mwita.

Kanja and Amin sought to set aside directives issued on January 8 and executed on January 13.

The orders obliged them to bring the three missing men to court and to appear in person.

They eventually filed an application, claiming that they were not served with the orders and that the court condemned them without hearing their case.

This was the reason they had the orders placed aside.

But, in his ruling, Justice Mwita stated that he was not convinced that the email account used to serve the IG and DCI was not their confirmed email address.

“I am therefore persuaded that they were served with the application and orders issued,” he said.
