Martha Karua Reveals Why She Withdrew From Ndiang’ui Kinyagia Case

Senior Counsel Martha Karua has stated that she did not represent blogger Ndiang’ui Kinyagia unilaterally, but rather in collaboration with the Law Society of Kenya (LSK).

However, when the LSK requested that they recuse themselves from the case, she was forced to follow suit and withdraw.

The People’s Liberation Party (PLP) leader was responding to reports that the blogger had been abandoned after being accused of self-abduction.

“But now, even the LSK and Martha Karua are distancing themselves from his case,” the post read in part.

“As the spotlight dims, he’s been left to face the consequences alone, abandoned by the very voices that once rallied behind the cry, ‘Free Ndiangui’.”

Karua quickly responded, stating that Ndiang’ui deserves representation, even if it is not provided by her.

“I was appearing alongside LSK, and when LSK seeks to withdraw, I lose the locus; otherwise, I do think he deserves representation,” Karua wrote.

According to Karua, when LSK withdrew from the lawsuit, she lost her legal standing before the court in that particular matter because she was relying on LSK’s capacity.

The senior counsel went on to say that she did not agree with how the events surrounding the search for Ndiang’ui occurred.

These include the DCI breaking into the blogger’s home and causing trouble.

Do not forget, the police broke into his house without a warrant, and reigned terror on an entire neighbourhood. I do not judge him,” Karua noted.

Kinyagia, a software engineer, appeared before the Milimani Law Courts on Thursday, July 24, and revealed that he currently has only two lawyers, Kibe Mungai and Wahome Thuku.

LSK first supported a habeas corpus petition, stating Kinyagia was taken by state operatives under questionable circumstances.

However, investigations revealed that he had purposely gone into hiding, eroding the petition’s credibility and prompting a quick court reversal.

In new court files, LSK’s legal team, VR Advocates & Partners LLP, formally requested to withdraw from the case, citing contradictions in Kinyagia’s account and a breakdown in trust between client and counsel.

Meanwhile, Kinyagia has been given 14 days to submit an affidavit explaining his disappearance on June 21.
