IMPEACHMENT STILL ON? Nyamira MCAs To Challenge Governor In Court
A part of the Nyamira County Assembly has decided to appeal the Senate’s decision to overturn Governor Amos Nyaribo’s impeachment.
This comes after the Senate failed to reach the two-thirds majority required for an impeachment vote.
During a media event on December 4, 2025, the MCAs criticized the Senate for overturning the motion without opening the impeachment case files.

James Mating’a, the Member of County Assembly for Kemera Ward, stated that the MCAs are dissatisfied with the Senate’s decision and will challenge the two-thirds threshold verdict in court.
“We have many ways of dealing with this impeachment; we shall go to court for the court to decide this issue on the number of MCAs that make up the two-thirds,” Mating’a said.
Nyamira County Assembly Majority Leader George Mora Abuga also stated that some Senators altered their minds following the one-hour recess sought by Senate Majority Leader Aaron Cheruiyot.
“What happened in that one-hour break that my colleague Majority Leader in the Senate asked for, that the Senate decided to vote on the preliminary objection and three-quarters of them who were supporting us crossed over and supported the preliminary objection?” Abuga asked.

The MCAs argue that the Senate did not address critical concerns affecting Nyamira citizens, which Governor Nyaribo was accused of in the impeachment motion.
In his third impeachment motion, Governor Nyaribo was accused of participating in, promoting, and supporting the unlawful and unconstitutional Bunge Mashinani initiative.
Nyaribo also allegedly provided illegal assent to the Nyamira County Supplementary Appropriation Bill, 2024.
Nyaribo was accused of neglecting to deliver the State of the County Address and Annual Reports, as well as failing to comply with court orders directing Clive Ogwora’s appointment to the County Executive Committee.

The Assembly also chastised the Governor for attempting staff recruiting without fiscal support.
This affected the irregular appointment of senior human resources executives, as well as his personal enrichment via irregular wage arrears.
The MCAs accused the Governor of payroll fraud, public monies loss, dual appointments outside of the lawful establishment, and usurpation of the Auditor-General and the CPSB’s authority, among other charges.

With thirty-eight Senators voting to overturn the impeachment motion and only four opposing the preliminary objection by the Governor’s legal team, Governor Nyaribo survived impeachment for the third time.
