OF THE HOOK: Governor Mwangaza Receives Relief As MCAs Withdraw Impeachment Motion

Meru County Assembly has withdrawn its notice of motion to impeach Governor Kawira Mwangaza.

During the afternoon seating, the motion’s mover, MCA Zipporah Kinya, tabled a notice to withdraw the impeachment bid, which was then debated and approved by the members.

“This assembly approves the request by the deputy leader of the majority party Zipporah Kinya to withdraw the notice of motion for the removal of office of Governor Kawira Mwangaza by impeachment whose notice was issued on Wednesday, July 17, 2024,” said the Speaker.

One of the primary reasons for the motion’s withdrawal was time constraints, as such a motion should be debated and sent to the Senate within 10 days of notice.

Second, by withdrawing the motion, the ongoing court case loses its subject matter and becomes null and void.

Furthermore, the withdrawal means that any MCA, including the mover, has the authority to reintroduce the impeachment motion because it has not reached the debate stage.

On Monday, the High Court of Meru referred Mwangaza’s impeachment motion to Njuri Ncheke for alternative dispute resolution.

According to court documents obtained by Citizen Digital, Mwangaza and her advocates are scheduled to appear before Njuri Ncheke on Wednesday, July 31.

Njuri Ncheke was also ordered to submit their resolution, or lack thereof, in the dispute no later than three weeks from Monday, July 29, with the ruling deferred until August 20.

The development came after the Assembly stopped debating the motion on Friday in response to a High Court order issued on Wednesday, which temporarily halted the proceedings until the court issued further instructions.

Prior to the ruling, Mwangaza filed a petition challenging the planned impeachment motion, claiming that it was initiated by her political opponents.

Meanwhile, Njuri Ncheke declined the court’s request to hear a notice of motion of impeachment against Meru Governor Kawira Mwangaza, stating that they do not handle constitutional matters.

Nominated Member and Deputy Leader of the Majority Party Zipporah Kinya filed the impeachment motion citing gross violations of the Constitution, various national and county laws, and abuse of office.

The notice of motion made numerous specific allegations against Mwangaza, including illegal appointments and dismissals, financial misconduct, and misleading the public.

She was also accused of revoking CPA Virginia Kawira Miriti’s appointment as Secretary/CEO of the Meru County Public Service Board without proper authorization and in violation of the law.
