High Court Rules On Sarah Wairimu Case Over Tob Cohen’s Murder

Sarah Wairimu Cohen has been remanded in custody until a bail hearing on February 3, according to the High Court.

This comes after the court denied the prosecution’s request that Wairimu undergo another mental assessment exam before pleading guilty to the murder charges against her late husband, Dutch billionaire Tob Chichou Cohen.

Wairimu appeared before Lady Justice Diana Kavedza and pleaded not guilty to murdering the businessman.

The charges brought before the court lie under Section 203 of the Penal Code, which deals with murder.

According to a statement released by the Office of the Director of Public Prosecutions (ODPP), Wairimu and others not present in court conspired to murder Cohen during the night of July 19 and 20, 2019, in the Lower Kabete region of Nairobi County.

The prosecution has sought that Wairimu undergo another mental evaluation before pleading guilty to the charges.

Judge Kavedza denied the request, stating that Wairimu had taken the same test when she was arrested in 2019 over the matter.

She ordered that the 2019 mental evaluation exam be submitted in court, and after that, she directed Wairimu to enter a plea in the matter and scheduled a bail hearing for February 3.

Wairimu was rearrested on Friday, January 24, after the DPP discovered new evidence linking her to the death of the Dutchman.

She was originally detained in 2019 when the Dutchman’s body was discovered in a septic tank on July 19 in the Lower Kabete area.

She did, however, inform the authorities that her husband was murdered and put into the septic tank while she was in police custody.

The case was abandoned two years ago after the then-DPP, Noordin Haji, told a Nairobi court of his decision to drop the charges against Wairimu and her co-accused.

He further stated that rather than prosecuting the murder case, the court should order an inquest to be held in the Milimani Law Court.

The case was revived because DPP Benson Ingonga determined that there was overwhelming evidence that Wairimu murdered her husband.
