EACC Files Suit Against UDA Governor Over Ksh813 Million Road Tender
The Ethics and Anti-Corruption Commission (EACC) has filed a High Court case demanding Ksh813 million from Kiambu Governor Kimani Wamatangi and 13 others for alleged misconduct and conflicts of interest in the allocation of road building projects.
The commission noted that its investigations had found that the funds were obtained through irregular payments.
The payments came from the Kenya National Highways Authority (KeNHA), the Kenya Urban Roads Authority (KURA), and the Kenya Rural Roads Authority (KeRRA) between the fiscal years 2018/19 and 2021/22.
The EACC believes that Governor Wamatangi exploited his position as Chairperson of the Senate Standing Committee on Roads, Transportation, and Housing to influence the allocation of contracts to five companies linked to him.

Furthermore, the committee claims that the corporations utilized fake bid documents and exaggerated technical credentials to gain lucrative contracts.
“Further investigations established that Hon. Wamatangi, while abusing his position of trust and acting in conflict of interest, colluded with companies linked to him to engage in fraudulent practices by submitting forged and falsified bid documents to unlawfully secure tenders,” EACC said.
At the same time, the five companies reportedly got around Ksh726 million from KeNHA and KURA, as well as Ksh86 million from KeRRA.
The anti-graft authority contended that the payments were irregular, illegal, and the proceeds of corruption.
It further stated that the governor concealed his ownership of the companies by delegating directorships to family and proxies while maintaining control of the bank accounts.
Investigators apparently discovered that he remained a signatory to the companies’ accounts despite pretending to have given up authority.
This, according to the commission, constituted him the beneficial owner and primary beneficiary of the monies in dispute.

“Investigations revealed a clear pattern of concealment and abuse of office designed to misappropriate public funds through fraudulent tenders and false declarations.”
Meanwhile, the suit was filed in Milimani Anti-Corruption Court, with the governor and 13 people named as defendants.
Lady Justice Lucy Njuguna directed that the application be heard on November 18, 2025, when the parties are expected to present for the procedures session.
