IEBC Fines Gachagua’s Close Ally Ksh1.5M Over Incisive Remarks In Ol Kalou

Kipipiri MP Wanjiku Muhia was fined Ksh1.5 million by the Independent Electoral and Boundaries Commission (IEBC) for allegedly making provocative comments during a recent rally in Nyandarua County.

Muhia was also ordered to publicly apologize by the IEBC’s Electoral Code of Conduct Enforcement Committee, which also threatened to prevent her from running in future elections if she didn’t follow its instructions.

“The committee has established that the respondent has violated paragraph 6A,” the committee ruled.

“The complaint has been proved on the balance of probabilities, being the standard applicable to these quasi-judicial proceedings.”

Speaking on Friday, July 10, IEBC Commissioner Alutalala Mukhwana stated that the ruling was based on the parties’ submissions, the relevant legislation, and the oral and written evidence that was given throughout the proceedings.

As part of its orders, the committee issued a formal warning directing Muhia to refrain from making similar remarks in the future.

It stated that her statements were capable of inciting Kenyans to violence, intimidation, hatred, and hostility.

While issuing the orders, the Committee directed the vocal lawmaker to pay the fine to the IEBC within 72 hours of the delivery of the judgment.

The committee further cautioned that failure to comply with its orders would attract additional sanctions under the Elections Act.

This includes the possibility of being barred from participating in any elections conducted by the IEBC.

“Failure to comply with the orders issued herein shall attract sanctions as provided for under the Elections Act, including issuing an order barring her from participating in any elections conducted by IEBC,” Commissioner Mukhwana stated.

The committee’s decision stemmed from remarks allegedly made by Muhia during a recent political rally in Nyandarua County, where she urged residents to organise themselves into groups of ten and monitor outsiders.

Her remarks quickly went viral, attracting backlash from Kenyans, including the political class, consequently leading to her summoning by the commission last week.

She was initially summoned by the Directorate of Criminal Investigations (DCI) in Ol Kalou to record a statement regarding the incitement allegations.

Meanwhile, during the briefing, Mukhwana also announced that the Commission had summoned Nakuru Town East MP David Gikaria to answer allegations of breaching the Electoral Code of Conduct during the ongoing Ol Kalou by-election campaigns.

This is after Gikaria openly admitted to distributing Ksh1.2 million to crowds during a political rally in Ol Kalou, stating that his team was allocated money to share within designated wards in the area.

“On Monday, this committee summoned David Gikaria, the MP for Nakuru Town East, to appear to respond to allegations of breach of the Code of Conduct in the ongoing Ol Kalou by-elections,” the Commissioner said.
