High Court Rules On Governor Wamatangi’s Arrest, Prosecution

The High Court has issued a new order to halt the arrest and prosecution of Kiambu Governor Kimani Wamatangi.

In issuing a conservatory order, Justice Chacha Mwita stated that the Office of the Director of Public Prosecutions (ODPP) and the Ethics and Anti-Corruption Commission (EACC) should not arrest or charge the governor while the current case is ongoing.

“A conservatory order is hereby issued by refraining respondents from arresting and charging the petitioners based on the investigations undertaken in this matter until September 18, 2025,” the judge said in the ruling.

The court’s ruling implies that Wamatangi will not be arrested or charged in connection with the current investigations.

The EACC is examining charges of corruption within his government until the court issues its final decision in September.

The case will return to court on September 18, where judges will decide whether to continue the legal process or lift the suspension.

The judge stated that the ODPP had yet to decide whether to prosecute the suspect or not.

The current court order allows the governor to continue doing his official duties until the court issues a final ruling in September.

On April 15, the anti-graft agency raided the governor’s house and offices, alleging misappropriation of public funds and a conflict of interest.

The officials were being investigated for mismanagement of funds in the county.

During the questioning, county officials denied the allegations as part of a political campaign to undermine Wamatangi’s government.

The governor further stated that the raid was political intimidation and that he will not be silenced or distracted from overseeing county initiatives.
