
Family, MP In Heated Land Dispute Worth Over Ksh80M In Ruaka
An MP from Kirinyaga County is involved in a land dispute with a family from Kiambu.
The Kiambu family intends to file a lawsuit against the legislator, claiming they lost a prime parcel in Ruaka, Kiambaa constituency, worth Sh80 million.
When contacted for comment, the MP stated that he purchased the land from some Kiambu family members, who he claimed had a ready title deed for the property.
“I have copies of the succession that he (one of the brothers) did without my help,” the legislator said.
“I was not there during the succession. If there was any family feud, I was not aware of it since this was a buyer-seller transaction.”
He claimed he followed the proper procedures for acquiring land and denied influencing two family members to sell him the parcel.
The family of Munyui Gathwira (deceased) has accused the legislator of conspiring with some family members to deprive other members of their inheritance land.
According to Gathwira’s son, Fredrick Mburu, the legislator purchased the property without the consent of all family members.
“We are seven members who were documented as beneficiaries. We only recently learnt that two of our brothers conspired with the legislator and sold the land without our consent,” Mburu said.
He went on to say that the MP helped change the ownership of LR Kiambaa/Ruaka 618, which measures 0.510 acres.
This resulted in the removal of their brother, David Ngigi, as the registered co-administrator of the land, while other family members were listed as deceased.
“The sale of our land was facilitated after it was claimed that we are deceased. Our father’s legacy was meant for all of us and we have never authorised any transfer of ownership,” he said.
The family members claimed that corrupt dealings were carried out with land officials at the Kiambu lands registry, who issued fake death certificates for family members.
“Corrupt land officials in Kiambu facilitated this egregious act by accepting fraudulent death certificates. We are shocked and appalled by this blatant corruption,” Mburu said.
He stated that as soon as he learned of the sale, he immediately mobilised his siblings to obtain a restriction on the land from the assistant county commissioner’s office in Kihara, Kiambaa.
The restriction letter, written by five of the brothers and presented to Kihara assistant county commissioner Eldwin Ongeto on April 20, 2023, claimed that their brother registered LR Kiambaa/Ruaka 618 in his name.
The brothers expressed concern that their two siblings intended to dispose of the land without the consent of all parties.
“We request you to kindly restrict the land until such a time both parties come to an agreement,” read part of the restriction letter.
However, the family claims the legislator was able to remove the restriction, allowing for the successful transfer of the land documents.
They have promised to fight tirelessly until justice is done.
“The MP and our brothers will face the consequences of their actions. We demand accountability and restitution for this injustice perpetrated against our family,” Mburu said.
