Senator Omtatah Ordered To Sue Uhuru, Senior Gov’t Officials Over Kenyan Debt

On Saturday, April 26, the High Court directed Busia Senator Okiya Omtatah to serve a petition seeking accountability from former President Uhuru Kenyatta and senior government officials for the country’s debt.

The decision followed a lawsuit filed by the lawmaker and eight others seeking legal accountability from the previous Head of State and top officials for the large debts incurred.

Surprisingly, this includes the current Treasury Cabinet Secretary, John Mbadi.

In the court notice, Justice Bahati Mwamuye directed the Busia Senator to serve the petition to all respondents and interested parties by May 2, this year.

Justice Mwamuye further directed the respondents and interested parties to submit their responses by May 23.

“The timelines shall strictly be applied and enforced,” Mwamuye stated.

“The petitioners shall also separately file and serve a table indicating the relative position of each respondent and each Interested party based on the responses,” Justice Mwamuye directed.

Omtatah and eight other Kenyans filed a petition questioning the constitutionality of loans obtained by President William Ruto’s government totaling Ksh2.2 trillion.

In the lawsuit, the legislator also seeks to hold Attorney General Dorcas Oduor, Controller of Budget Margaret Nyakang’o, Auditor General Nancy Gathungu, and Treasury Principal Secretary Chris Kiptoo accountable for the country’s massive debt.

Other respondents to the suit include former Controller of Budget Agnes Odhiambo, former Auditor General Edward Ouko, former Attorney General Githu Muigai, former Treasury CS Henry Rotich, and former Treasury PS Kamau Thugge.

Omtatah and the co-petitioners also accused the present and prior governments of violating the Constitution by acquiring large loans without justification.

According to the complainants, the government improperly transferred Eurobond monies to an offshore account instead of the Consolidated Fund, exposing the funds to misuse.

“Billions have been borrowed through off-budget loans; loans that never passed through Parliament for approval, borrowed unconstitutionally and not tied to any development projects, as the law demands,” Omtatah contended.

“The petitioners believe this was done with improper or corrupt motives, without consideration for the public interest,” read part of the petition.
