High Court Deals Waititu Another Blow After Second Bail Application

The High Court has denied former Kiambu Governor Ferdinand Waititu’s second bail application while he awaits the outcome of a graft appeal.

Justice Lucy Njuguna denied the former governor’s application on Thursday, May 8, citing a lack of merit.

“I am not persuaded and in respect to the present application and for the reasons this court has given, it holds a strong view that the application lacks merit and is hereby dismissed,” Justice Njuguna said.

According to the court order, Waititu and his two co-accused will remain in detention till the outcome of their appeal in the Ksh588 million graft case.

Justice Njuguna’s decision to reject Waititu’s bail application comes just a month after she denied a similar request by the former governor’s legal team.

On March 26, the judge denied a similar application on the grounds that the petitioner failed to persuade the court that his appeal had a strong possibility of success.

Justice Njuguna also denied Waitutu’s legal team’s request that the former governor be released from prison due to his illness.

“It is my finding that the applicants have not met the conditions for bail. The applications are hereby dismissed,” Justice Njuguna ruled in March.

Waititu was imprisoned at Kamiti Prison when anti-graft Court Magistrate Thomas Nzioki convicted him of conflict of interest and earning millions in a road tender through corrupt ways.

In the February 13 ruling, Justice Nzioka condemned the former county administrator to 12 years in prison with the option of paying a Ksh53 million fine.

The court ordered Waititu’s wife to pay a Ksh500,000 fine or spend a one-year sentence in prison.

While delivering the judgment, the magistrate stated that Waititu’s actions could not be forgiven because they compromised the principles of good governance.

The sentencing came after a successful application by the Director of Public Prosecutions (DPP).
