Court Bans Mandera Governor From His Nairobi Flats Indefinitely
The Environment and Land Court approved the Ethics and Anti-Corruption Commission (EACC) preservation orders against Mandera Governor Mohamed Adan Khalif for his Parklands property.
According to court records dated Wednesday, February 11, the governor will be prohibited from entering, invading, digging, constructing, developing, inhabiting, selling, transferring, taxing, or wasting the land.
The county chief, as well as his agents and workers, were forbidden from the property for the next six months, according to Section 56 (3) of the Anti-Corruption and Economic Crimes Act.
On January 26, the EACC requested that the court issue orders. Justice T. Murigi stated that the court will hear the case on March 5.
“An order of preservation, be and is hereby issued preserving the property referred to as LR.No 209/12670, by prohibiting the 1st Respondent and its agents, servants or any other person from entering, encroaching, excavating, constructing, developing, occupying, selling, transferring, charging, wasting or in any other way dealing with the property aforesaid,” the judge said.
“The matter to be heard inter partes on 5th March 2026. Given under my hand and seal on this Honourable Court in Nairobi, this 2nd February 2026,” the judge said.

The EACC informed the court that the land was originally designated for the construction of a school, but it was later improperly subdivided and given for private residential use.

According to the commission, the governor fraudulently bought the 0.1581 hectares of land in 2021 and registered it under Land Reference No. 209/12673.
EACC stated that the preservation orders against the property’s owners will open the way for investigations and the recovery of the land so that it can be used for public purposes.
“The Applicant is carrying out investigations with a view to, inter alia, instituting proceedings for restitution of the said properties to the public for the intended public utility for which they were originally reserved for,” EACC’s advocate said.
