LEGAL: Court Denies Waititu’s Bond Request Pending Appeal

The High Court has denied former Kiambu Governor Ferdinand Waititu’s bid to be released on bond until the hearing and conclusion of his appeal.

Justice Lucy Njuguna stated that the applicant had not persuaded the court that his appeal had a good prospect of success.

She also disagreed with Waititu’s claim that he should be released on bond due to his illness.

“It is my finding that the applicants have not met the conditions for bail. The applications are hereby dismissed,” Justice Njuguna ruled.

Waititu has been in jail since anti-corruption court chief magistrate Thomas Nzyoki found him guilty of conflict of interest and dealing with suspect property charges after fraudulently collecting millions from Kiambu county through a Sh588 million procurement.

He was given the choice of paying a fine of Sh53.7 million or serving 12 years in prison.

Earlier, Waititu’s Advocate Danstan Omari filed a plea with the High Court to be admitted to reasonable bond until the outcome of Waititu’s appeal.

He asked the court to enable the bond security he had deposited during the trial to be used as a continuing bond to ensure his release. It was worth Sh50 million at the time.

The former Kiambu governor then stated that if he remained in detention, he would suffer as a result of his medical condition, which is violent high blood pressure and requires continual urgent medical attention.

“I believe that the instant appeal has a chance of success and that I will be prejudiced if the sentence is executed,” he said then.

Waititu claimed that trial Magistrate Thomas Nzyuki neglected to consider his evidence and did not measure it against that of the prosecution in reaching a proper judgment.
