Protests Erupt After Court Ruling On Gachagua Impeachment
On Tuesday, June 9, a group of boda boda operators in Embu Town took to the streets to protest the High Court’s decision to uphold the impeachment of former Deputy President Rigathi Gachagua.
The protests, led by local lawmaker James Ireri, accused the three-judge bench of issuing an inconsistent and unjust verdict on the Senate’s handling of Gachagua’s removal.
The demonstrators contended that the court failed to act on its own conclusion that Gachagua’s right to a fair hearing was infringed during the Senate impeachment hearings.
Speaking during the protests, Ireri claimed that the judges should have nullified the impeachment after concluding that the former DP’s constitutional rights had been infringed.
“I want to say that the ruling that was issued by the High Court yesterday is a misleading and confusing ruling,” said Ireri.

“On one hand, the High Court said the rights of the former DP were infringed, and that is reason enough to quash the ruling against Gachagua,” he added.
“The Senate did wrong, and they should admit they did wrong.”
While addressing the press during the protests, the politician announced plans to recall Senator Munyi Mundigi over reports of voting in favour of Gachagua’s impeachment.
“Since the senators did not do the right thing, we have decided as the people of Embu to begin the process of recalling our senator because he voted in favour of Gachagua’s impeachment,” Ireri stated.

On Monday evening, the High Court upheld the Senate’s decision to remove Gachagua from office, dismissing a series of consolidated petitions challenging the impeachment process.

In a ruling delivered on Monday, June 8, a three-judge bench comprising Justices Eric Ogolla, Anthony Mrima and Fridah Mugambi ruled that both Parliament and the Senate acted within the law during the impeachment proceedings.
The court found that the National Assembly complied with constitutional requirements, including public participation, and that the impeachment process met the legal threshold required under the Constitution.
However, the judges also determined that Gachagua’s right to a fair hearing was violated during the Senate trial due to procedural irregularities that limited his ability to adequately defend himself.
According to the judgment, the violation was significant enough to warrant compensation but not sufficient to overturn the impeachment outcome.
The court, in turn, awarded Gachagua Ksh50 million in damages to be paid by the Senate.
