Mining Ministry Appoints 2 State Officers For The Same Committee Jobs In 3 Different Counties

Mining Cabinet Secretary Hassan Joho announced on Friday a number of appointments to County Mining Committees in three counties.

However, two of the appointees received the same positions in multiple countries at the same time.

The CS announced in a gazette notice dated Friday, September 13, 2024, the appointment of Mourice Amalemba to the Bomet and Nakuru artisanal mining committees, as well as Sylvanus Too to the Bomet, Nakuru, and Nandi committees.

The appointments, however, raised concerns, particularly about whether the appointees will be able to carry out their duties effectively and meet the specific requirements.

Another concern was whether the CS could appoint other Kenyans with the necessary qualifications to fill the positions without duplicating efforts.

However, in the appointment of Mourice Amalemba, the notice stated that he will serve under section 94 (2) of the Mining Act under paragraph (b) for both Nakuru and Bomet Counties, and Sylvanus Too under paragraph (e) for the three counties of Bomet, Nandi, and Nakuru.

The moves do not violate any of the provisions of the Mining Act because, in the case of Mourice Amalemba, the Act states in paragraph (b) that his responsibility will be to act as the representative of the Director of Mines (National Director) and Secretary to the committee.

On the other hand, Sylvanus Too’s appointment under paragraph (e) of the Mining Act will make him a representative of the Ministry of Mining’s inspectorate division in the three counties.

The two appointees, along with others, will serve on the County Artisanal Mining Committees for three years, beginning on September 13 of this year.

The Committee members will advise the Director of Mines on the granting, renewal, and revocation of artisanal mining permits in the counties they represent.

Joho’s appointments came after he embarked on an extensive tour of the country to become acquainted with the industry after taking office.

During the tour, the CS was informed that Nandi County miners were dealing with their groups wrangling over mining issues.
