ODPP Declines To Charge Kisii-Based Blogger After DIG’s Accusations
The ODPP has announced the release of Kelvin Moinde, a Kisii blogger arrested last weekend on false publication allegations.
Moinde was allegedly captured in Kisii on Saturday, June 7, and brought to Nairobi, where he was held at the Kamukunji Police Station.
Moinde was arrested by authorities from the Directorate of Criminal Investigations (DCI) for social media posts allegedly disparaging the Deputy Inspector General of Police, Eliud Lagat.
On Monday, the ODPP declared on its official X account that the Director of Public Prosecutions (DPP), Renson Igonga, did not find adequate evidence to indict Moinde.

“The Office of the Director of Public Prosecutions (ODPP) acknowledges receipt of the inquiry investigation file on Mr KELVIN MOINDE,” ODPP stated.
“Upon careful perusal of the inquiry file, the Director of Public Prosecutions (DPP) is satisfied that there is NO sufficient evidence to charge Mr Kelvin Moinde,” he added.
Moinde was detained on the same day as the late Albert Ojwang, who was apprehended on Saturday in Homa Bay and taken to the Central Police Station.
Police say Ojwang banged his head on the wall, inflicting injuries that led to his death while in police custody at the police station.
The killing of Ojwang, a well-known blogger, has sparked considerable public outrage, with Ojwang’s family and Kenyans continuing to demand justice and an explanation for what happened that night.
According to a statement issued on Monday by Inspector General of Police Douglas Kanja, Ojwang was also being investigated for allegedly defaming Lagat on social media.
According to Kanja, the DIG filed an official complaint against Ojwang, which led to his arrest and further questioning.

The IG stated that Ojwang was not mistreated while in police custody and insisted that his deputy, like any other Kenyan, had the right to complain.
“There was a complaint that had been logged by the DIG KPS (Eliud Lagat) that his name was being tarnished, and that is why Albert Ojwang was arrested,” Kanja said.

The IG’s declaration came hours after Deputy President Rigathi Gachagua asked for Lagat’s suspension.
Gachagua said that Lagat was “personally” operating the Kamukunji and Central Police Stations in Nairobi without Kanja’s knowledge.

According to the former DP, suspending the Deputy IG will pave the way for real inquiries into what caused Ojwang’s death.
“People are complaining that those two stations have become the new torture chambers. That is the reason Albert had to be moved from Homa Bay to Central Police Station in Nairobi,” Gachagua alleged.
