MOMBASA: EACC Recovers Ksh50 Million Land For Kenya Railways

A parcel of land belonging to Kenya Railways has been reclaimed in Mombasa County, years after it was illegally transferred to private entities.

The land, valued at Ksh50 million, was discovered to have been improperly transferred to a real estate business in 2011.

The EACC discovered that the site, which is around 0.0873 hectares, had historical ties to Kenya Railways.

It also comprised structures built by the East African Railways and Harbours Corporation in the 1950s.

A four-bedroom house and a garage were among the structures built on the prime plot of property, which was located along Pwani Road near the intersection with David Kayanda Road.

Despite its association with Kenya Railways, the property was controversially sold to a real estate developer.

Following its investigations, the EACC filed a recovery suit at Mombasa’s Environment and Land Court in 2020.

This resulted in a consent agreement with the developer, whose business agreed to surrender the property to the state for formal registration in favor of the Kenya Railways Corporation.

In addition to surrendering the land, the court granted a permanent injunction prohibiting the developer from transferring, alienating, or otherwise dealing with the land.

In addition, the corporation was forced to invalidate the original lease certificate.

The land registrar will then have to correct the lease to show Kenya Railways as the rightful owner.

This was yet another historic case in which the EACC seized state-owned land intended largely for infrastructure projects.

A week earlier, still in Mombasa County, the EACC seized an exceptionally valuable parcel belonging to the Kenya Airports Authority (KAA) that had allegedly been fraudulently obtained by a former Coast Province physical planner.

According to court findings, the land, valued at Ksh104 million, was originally designated for public use but was illegally distributed to private organizations through the former government official’s influence.

Previously, in June, 12 pieces of stolen public land totaling Ksh320 million were recovered in Bungoma and Kakamega counties.
