Kenya’s High Court Issues Orders On DP Gachagua’s Impeachment

On Thursday, the High Court in Nairobi declined to issue orders prohibiting public participation in a motion before the National Assembly to impeach Deputy President Rigathi Gachagua.

Despite certifying the petition as urgent, the court directed the parties involved to appear before it on October 10 for further instructions on the matter.

“The Application dated 02/10/2024 shall mentioned on 09/10/2024 virtually to confirm compliance and to take directions on the expedited hearing and determination of the matter,” the court directed. 

“The Court may on that day issue such interim conservatory orders or further directions as shall be deemed just, fit, and proper to issue pending the hearing and determination of the matter,” the notice read further.

The directive comes hours after the deputy president petitioned the court for conservatory orders to halt his impeachment.

Gachagua’s lawyers claimed that the motion to impeach him was based on deception and misrepresentation of material facts.

In his petition, the second-in-command criticized the National Assembly for allocating insufficient time for public participation, which he described as grossly inadequate to facilitate any meaningful and reasonable public engagement.

He also accused National Assembly Speaker Moses Wetangula and Deputy Gladys Shollei of bias for publicly declaring their preferred outcome for Gachagua’s impeachment.

According to the deputy president, the impeachment motion was politically motivated and intended to undermine the Kenyan people’s sovereign will.

“The intended impeachment process against me essentially seeks to overturn the sovereign will of the majority of Kenyans who voted for me to be the Deputy President of the Republic of Kenya,” Gachagua alleged in his petition.

According to the deputy president, impeachment is a serious matter that should be handled in accordance with the conditional provisions and parliamentary rules of procedure.
